The Idaho State Department of Insurance (department) filed a complaint against Glen Cox, a licensed insurance agent, alleging inter alia, violations of the anti-rebate statute, I.C. Â§ 41-1314. In the initial complaint, the department sought a revocation or suspension of Coxs license and/or a fine not to exceed $1,000. After a hearing was held by a department hearing examiner, Cox was fined $1,000.[Footnote 1] Cox then appealed the departments decision to the district court which reversed the hearing examiners Conclusion that Cox had violated I.C. Â§ 41-1314, ordered the fine to be refunded and, in a separate order, awarded costs and attorney fees to Cox.
